Watch | Transnational killings | The legal rights and wrongs

This week, we are looking at the legal wrongs and rights of transnational killings- and the sometimes confusing stand of the government. To recap the developments this week:

British Newspaper Guardian reported this week that Indian intelligence agents are believed to have orchaestrated up to 20 killings of alleged Khalistani separatist and Jihadist terrorists in Pakistan. In the article the MEA denied the charge, and cited External Affairs Minister S. Jaishankar’s previous statement that “targeted killings is not India’s policy”

However, in campaign statements and an interview by Defence Minister Rajnath Singh, the government appeared to be accepting the charges

PM Modi also repeated his 2019 slogan of “Ghar mein ghus ke marenge” for terrorists- or “We will kill them in their homes”

Diplomatic Fallout:

The immediate diplomatic fallout of the remarks came from Pakistan, where the MFA has already accused India of the killing of 2 men in Pakistan earlier this year, and said “India’s assertion of its preparedness to extra-judicially execute more civilians, arbitrarily pronounced as ‘terrorists’, inside Pakistan constitutes a clear admission of culpability.” However, given the poor state of relations with Pakistan, this is unlikely to be an issue for New Delhi

The U.S. State department declined to comment on the story, but the larger question is, will the assertions by the government be used by the U.S. Justice department, who is expected to begin the trial this summer of Nikhil Gupta, a man the FBI claims hired hitmen against Khalistani separatist Pannun in New York last year at the behest of senior Indian intelligence officials

And Canada, that is yet to provide evidence of its claims, continues to say it is pursuing the involvement of Indian government agents in the killing of Khalistani Separatist Nijjar outside Toronto last year. PM Trudeau doubled down on the claims in a public hearing this week

So what is the international law that operates here? In fact there are three laws:

1. International Human Rights Law – that derives from the Universal declaration on Human Rights- guaranteeing every citizen’s right to life and liberty

2. International Humanitarian Law- which sets down principles of protecting non-combatants during armed conflict- saying they must be protected, and that states have certain obligations even during war or self-defence operations

3. United Nations Charter or Chapter VII on Action with respect to Threats to the Peace, Breaches of the Peace, and Acts of Aggression- Article 51, Which says nothing impairs the right of individual or collective self-defence if an armed attack occurs against a Member of the United Nations

On this week’s Parley at The Hindu, I asked two experts, former Ambassador Rakesh Sood, and analyst Dr. Tara Kartha, on whether there is a double standard for India and where the line on targeted transnational killings should be drawn?

Rakesh Sood: There is no clear definition in international law of targeted killings in that sense, but what has happened conventionally, is that let’s say there is an individual who is internationally designated as a terrorist, which means it will be he or she will be designated as a terrorist under the UN, United Nations Security Council, designation designation is number one, number two. On top of that, there is a very clear sense that it is very difficult to get hold of this person, or get the person extradited. Or in any way brought to face judicial proceedings. And add to that, a third factor that if it is felt that the person continues to remain engaged in terrorist activity and so therefore, a state feels that it is preferable and to use lethal force in a pre emptive fashion, in a manner in which it is precise. So that it does not pause you know, additional damage or does not. You know, collateral, collateral damage or kill other people, innocent people etc, etc. Then, that is seen in common parlance, that is what is called a targeted killing

Tara Kartha:  I think there are massive double standards because you’ve had the sort of targeted killings has come out from what post 911 when they use drone strike, they used every kind of attack, not just in Afghanistan, but you remember George Bush is called to the world and we will attack you wherever you are because it’s self-defence. So the antenna What shall we say the underlying criteria for any such attack targeted attack killings is self-defence. And it is allowed by the UN because the UN Charter says you have article 51 says you have a right individual right of self defence now the thing is, if since we are talking in relation to the Guardian story and zoom, is that the problem with that article is it it brings in assassinations, targeted killings, and extrajudicial killing all in the same basket in the same article, which is strange. Each one has a different legal connotation to it.

WV Take: There is no question that global powers set different standards for themselves and for other countries like India. India’s rise in the world thus far has come on the backs of a moral principle and when it comes to transnational operations, maintaining distance and deniability. If the government wants to go public with its assertions- it must ensure India has the diplomatic heft to deal with the consequences, which could escalate.

We were beaten throughout the day, says J&K civilian

There is growing evidence indicating torture by sprinkling salt and chilli on the wounds of rounded-up civilians, in the wake of the militants’ ambush that left four soldiers dead in Dera Ki Gali in the Poonch-Rajouri sector on December 21. Local people claim two civilians could be seen in the 29-second viral video of “torture” allegedly committed by the security forces. Farooq Din, son of Gulab Din, a resident of Upper Bangai, Thanamandi, was among five “severely injured” admitted at the Rajouri hospital. They were all rounded up from Upper and Lower Bangai and Haspalote areas in Rajouri’s Thanamandi on Friday morning around 9 a.m., a day after the attack.

‘Blast-like’ sound heard near Israel Embassy in Delhi; no explosive found

An explosion-like sound was heard behind the Israeli Embassy on Thursday evening; however, no explosive was recovered from the spot, the police said on Tuesday. A PCR call was received at 5.53 p.m. regarding a loud noise behind the Embassy of Israel, and Jindal House, the police said. “Considering the sensitivity of the location, and mention of explosion-type sound, senior officers rushed to the location,” DCP (PRO) Kumar Gyanesh said.

Despite gazette notification, confusion over implementation of three criminal laws

A day after the three criminal laws received President’s assent and were notified in the official gazette, confusion prevailed in police stations and courts regarding its implementation, according to several police officials .three legislation replace the British-era laws but in the absence of the required paraphernalia on the ground and adequate training of police officials, it will be several months for the Acts to be effective. Union Home Minister Amit Shah said in Chandigarh on December 22 that the framework to implement the laws in all the union territories would be ready by December 2024.

Railways spending big on PM’s selfie booths: RTI reply; brazen waste of money, says Opposition

The Centre is spending up to ₹6.25 lakh on every permanent 3D selfie booth with Prime Minister Narendra Modi’s image in railway stations, according to a reply obtained from Central Railway on a Right to Information (RTI) application. The cost incurred on each temporary selfie booth is ₹1.25 lakh. In reply to a query filed under the RTI by a retired railway official, Ajay Bose, Central Railway deputy general manager Abhay Mishra has said that it had installed or erected Mr. Modi’s 3D selfie booths across 50 railway stations in five divisions – Mumbai, Bhusaval, Nagpur, Pune and Solapur.

Anti-militancy operations in Poonch enter sixth day

Security forces continued with the anti-militancy operation in the Poonch-Rajouri sector in the Pir Panjal Valley for the sixth day on Tuesday, to trace those behind the December 21 attack that left four soldiers dead. Officials said security forces, aided by helicopters and drones, continue to comb the dense forests and high peaks around Dera Ki Gali, the spot where two Army vehicles were ambushed by militants last week.

Defence Minister Rajnath Singh has said he will visit Jammu and Rajouri on Wednesday. “Tomorrow, 27th December, I shall be in Jammu and Rajouri,” Mr. Singh said in a post on X on Tuesday. The Minister’s visit comes following the death of four army personnel, two of them captain, during an encounter between security forces and terrorists in Jammu and Kashmir’s Rajouri district last week. Three more soldiers were injured in the same encounter.

Israel Army arrests senior Palestinian lawmaker Jarrar

The Israeli Army on December 26 said it arrested senior Palestinian politician Khalida Jarrar in the occupied West Bank, along with other activists of her leftist party. Jarrar, 60, is a prominent figure in the Popular Front for the Liberation of Palestine (PFLP), a faction in the Palestine Liberation Organisation considered a “terrorist” group by Israel, the United States and the European Union.

Kashmir will become Gaza without India-Pakistan dialogue, says Farooq Abdullah

Former Jammu and Kashmir Chief Minister and senior National Conference (NC) leader and MP Farooq Abdullah on December 26 warned of a situation akin to Gaza in Palestine if India did not have a dialogue with Pakistan over Kashmir. “Dialogue is the only way forward to resolve lingering issues. If a conducive atmosphere for a dialogue is not worked out between India and Pakistan, the day is not far when J&K will become like Gaza, and people will suffer like in Palestine,” Dr. Abdullah said in Srinagar.

India’s fiscal deficit may breach 5.9% of GDP target: India Ratings and Research

India’s fiscal deficit may breach the 5.9% of GDP target for this year and could hit 6%, even though tax collections have been buoyant and may offset a wide shortfall in disinvestment outcomes, due to the likelihood of revenue spending exceeding the Budget Estimate by about ₹2 lakh crore, India Ratings and Research said on December 26. The Centre has recently secured Parliamentary approval for the first supplementary demand for grants this year, involving an additional cash outgo of ₹53,378 crore, lifting its total spending commitment for 2023-24 to ₹45.6 lakh crore, including about ₹35.6 lakh crore of revenue expenditure and ₹10.1 lakh crore of capital expenditure.

On Sunday, July 9, an article appeared in Dainik Bhaskar that said that Mayank Madhur, BJP leader and Kangana Ranaut’s political advisor and family friend, has decided to move court against the actress and the producers of Tejas. Mayank was quoted in the article stating that he helped in getting permissions for the filming of Kangana’s films He further added that he arranged Kangana, her sister and manager Rangoli Chandel, RSVP creative producer Salona Bains Joshi and director Sarvesh Mewara’s meeting with the defence minister Rajnath Singh. In return, Kangana and Sarvesh had promised to give him a 15-minute role in Tejas.

Mayank Madhur then revealed that after the meeting with Rajnath Singh, his role was shortened considerably. And when he asked for payment for his services, he was given false promises. Hence, he decided to sue Kangana and the makers of the film.

Bollywood Hungama exclusively spoke to Mayank Madhur and he said, “I was the one who arranged Kangana Ranaut’s meetings with the various chief ministers like Shivraj Singh Chouhan ji, Hemant Biswa ji and also Rajnath Singh ji. I helped with securing permissions for her films like Dhaakad, Tiku Weds Sheru, Tejas, Emergency etc. I also managed her various cases.”

When asked how he knew the National Award-winning actress, Mayank replied, “Kangana and I go back a long way. I met her when she used to do theatre at Asmita. At that time, I was a journalist at Deshbandu. I also worked for Navbharat Times, India Today, News 24 etc.”

Did he ever sign an agreement or contract regarding his role and its length in Tejas? Mayank Madhur answered, “No. These discussions took place in front of Rajnath Singh ji and also before we met the minister at The Leela Hotel in New Delhi. When a friend asks you for help, you don’t sign an agreement. It all works on trust. And she’s like family. My issue is that she made a commitment and she didn’t adhere to it.”

He further said, “For two years, she was trying to get permission to shoot Tejas in certain locations but her efforts were futile. I got it arranged in a day. The meeting with Rajnath Singh ji was supposed to be only for 10 minutes. But it went on for nearly two hours. I told the minister, ‘Apni hi bacchi hai. Please inki help kar dijiye’. I even asked Rajnath ji to give the mahurat clap for Tejas. But he couldn’t make it as he was busy with some work. Then as the film went on floors, Kangana would remind me that my shoot will soon happen but would also tell me ‘Aap Lucknow, Moradabad, Delhi ke shoot ka permission karwa dijiye’. She also asked me to get permission to shoot in Rajasthan and at air force bases. Meanwhile, the length of my role kept getting shorter. Then I was told to come to shoot for a 1 or 2-minute appearance. I made it clear that I am not interested.”

Mayank Madhur has been credited under ‘Special Thanks’ in Tiku Weds Sheru, produced by Kangana Ranaut. Mayank added, “For that film, she had assured me that I’ll be credited as associate producer. That didn’t happen and then she asked me to come on board for Tejas and Emergency. I even asked her why I should do so. After all, my political career is going fine. I asked her what my role in Tejas will be. To which she said that she wants my help in securing permissions. The director of Tejas, Sarvesh Mewara, has cheated me. Kangana had assured me that before the release of the film, she would arrange for my fees. But she’s not talking about it and now putting the ball in the court of the film’s makers. Hence, I decided to go to the court.”

When asked about his plan of action, Mayank Madhur chose not to divulge details, “I’ll not reveal right now when I plan to go to the court, which court I’d be approaching and how exactly will I stop the film’s release. I want to get the makers arrested. I have taken guidance from the former chief justice of India to understand how I can take the matter further. I have even spoken to the chief ministers, PMO, home ministry etc to ensure that arrest warrants can be issued immediately from various states. Everything will be done as per the legalities.”

Will he want to issue an arrest warrant against Kangana Ranaut as well? Mayank Madhur stated, “warrant will be issued against everyone who dealt with me and who cheated me, that is, the director, the producer and the actress etc. It was Kangana who got the director and producer involved.”

Kangana Ranaut’s team reached out to Mayank Madhur after the Dainik Bhaskar story was out. He revealed, “I spoke to her sister Rangoli. She has asked me to hold for a few days so that she can speak to the makers and get this thing sorted. I have agreed to it as Kangana is a friend and like a family member. But if I don’t get justice by then, then I’ll make sure I’ll stop the film’s release.”

Mayank Madhur signed off by talking about his main line of work, “I advise 156 central ministers, MLAs, MLC, and governors about their social media posts and their speeches in the assembly. In fact, I also write poetries and shayaris. I was the one who wrote the legendary quote ‘Aaj mera ghar toota hai, kal tera ghamand tootega’ after Kangana’s house was partly demolished by the Uddhav Thackeray government. She then posted it on her social media handle. I helped her tremendously during that crisis and was her legal advisor for her numerous cases. I even got her Y-security arranged in 24 hours.”

Sudan Army, rival extend truce, despite ongoing clashes

Sudan’s Army and its rival paramilitary said on April 30 they will extend a humanitarian cease-fire a further 72 hours. The decision follows international pressure to allow the safe passage of civilians and aid but the shaky truce has not so far stopped the clashes. In statements, both sides accused the other of violations. The agreement has deescalated the fighting in some areas but violence continues to push civilians to flee. Aid groups have also struggled to get badly needed supplies into the country.

In a first, Raj Bhavans to start celebrating Statehood days

Around 30 Raj Bhavans will hold programmes to mark the Statehood day of Maharashtra and Gujarat on May 1 in what is a new initiative as part of the government’s thrust on celebrating the country’s cultural diversity and different traditions. Official sources said different Raj Bhavans will host people of Maharashtrian and Gujarati origins living in the respective State and also organise different programmes to highlight the cultural riches and cuisines of the two western States. 

Suspected Islamic State leader killed in Syria by Turkish intelligence services: Erdogan

Turkish President Tayyip Erdogan said on Sunday that Turkish intelligence forces killed Islamic State leader Abu Hussein al-Qurashi in Syria. Mr. Erdogan said the intelligence organization had pursued Qurashi for a long time. Syrian local and security sources said the raid took place in the northern Syrian town of Jandaris, which is controlled by Turkey-backed rebel groups and was one of the worst-affected in the Feb. 6 earthquake that hit both Turkey and Syria.

Ukraine’s Defence Ministry deletes tweet allegedly depicting Goddess Kali following online outrage

A tweet posted by Ukraine’s Defence Ministry purportedly showing an image of Goddess Kali over a blast fume triggered online outrage following which the post was deleted. The Twitter handle @DefenceU posted the image with the caption “Work of Art”, triggering angry reactions from many Indian Twitter users who accused the Ukrainian Defence Ministry of insensitivity.

Ahead of 2024 Lok Sabha polls, CPI(M) to look at State-specific strategy 

At the end of the three-day meeting of the Central Committee, the Communist Party of India (Marxist)’s highest decision-making body, the party in a statement said the main task before the 2024 general elections is to “isolate and defeat” the BJP. And to achieve this, the party will work with other secular Opposition parties but electoral arrangements must be State-specific, as the political situation varies with each State. 

Nitish Kumar sidesteps query on fighting 2024 Lok Sabha poll

Bihar Chief Minister Nitish Kumar on April 30 sidestepped a query about the possibility of contesting the next year’s Lok Sabha poll from his pocket borough Nalanda. Sitting MP Kaushalendra Kumar, who is serving his third consecutive term, had on Saturday said he was willing to give up the seat if his mentor wished to enter the fray. “Just leave it. Why do you worry ( chhodiye na aap log kahe chinta karte hain)”, said the longest-serving CM of the State, as he walked past the posse of reporters with a smirk on his face.

Prime Minister Narendra Modi again chose to respond to the Congress’ jibe of poisonous snake against him by saying that the snake was a garland on the neck of Lord Shiva and that he would accept being a snake on the necks of the people of the country, whom he considered Lord Shiva.  It may be noted that AICC President Mallikarjun Kharge had described Mr. Modi as a poisonous snake recently, triggering a controversy. 

Congress dubs 100th episode of Modi’s radio programme as maun ki baat

As Prime Minister Narendra Modi completed the 100th episode of Mann Ki Baat on April 30, the Congress took a dig at Mr. Modi for being “ maun” [silent] on key issues such as China, Adani, increasing economic inequalities and the wrestlers’ protest. The official Twitter handle of the party also targeted the Prime Minister for being silent on key issues such as alleged Chinese aggression, unemployment, price rise, among others.

Inadequate space for cheetahs in Madhya Pradesh’s Kuno National Park: former Wildlife Institute of India official

Madhya Pradesh’s Kuno National Park (KNP), which has seen the death of two cheetahs in less than a month, has “inadequate space” for these felines brought from Africa, a former official of the Wildlife Institute of India has claimed. The National Tiger Conservation Authority (NTCA), which is overseeing the ambitious cheetah reintroduction project in the country, has called a meeting in New Delhi on Monday in the wake of the death of two cheetahs out of the 20 felines translocated to KNP from Namibia and South Africa over the last eight months, an official said.
