Trump charged in U.S. special counsel probe in efforts to overturn 2020 election

Former U.S president Donald Trump on Tuesday, August 1, 2023 was hit with criminal charges for a third time in four months – this time arising from efforts to overturn his 2020 U.S. election defeat – as he campaigns to regain the presidency next year.

The four-count indictment alleges Mr. Trump conspired to defraud the U.S. by preventing Congress from certifying President Joe Biden’s victory and to deprive voters of their right to a fair election.

Mr. Trump was ordered to make an initial appearance in federal court on Thursday, August 3.

The charges stem from Special Counsel Jack Smith’s investigation into allegations Mr. Trump – the front-runner for the 2024 Republican presidential nomination – sought to reverse his loss to Biden, his Democratic rival.

The indictment alleges Mr. Trump conspired with six other unnamed individuals to overturn the results. Prosecutors wrote that Mr. Trump knew his claims that the election was fraudulent were false, but repeated them anyway to “create an intense national atmosphere of mistrust and anger and erode public faith in the administration of the election.”

In a statement, the Trump campaign said he has always followed the law and characterised the indictment as a political “persecution” reminiscent of Nazi Germany.

Officials have testified that Mr. Trump pressured them based on false claims of widespread voting fraud. His supporters attacked the U.S. Capitol on Jan. 6, 2021, in a bid to stop Congress from certifying Biden’s victory.

The indictment accused Mr. Trump and co-conspirators of organising fraudulent slates of electors in seven states, all of which he lost, to submit their votes to be counted and certified as official by Congress on Jan. 6.

The co-conspirators were not named, but one of them appeared to describe former Justice Department official Jeffrey Clark, the former head of the civil division who tried to get himself installed as attorney general so he could launch voter fraud investigations in Georgia and other swing states. Clark did not immediately respond to a request for comment.

Another alleged co-conspirator appeared to describe attorney John Eastman, who erroneously suggested that Vice President Mike Pence could object to certifying the electoral results. Both Eastman and Clark had their phones seized and searched in the investigation last year.

Mr. Trump already had become the first former U.S. president to face criminal charges. He has sought to portray the prosecutions as part of a politically motivated witch hunt.

These represent a second round of federal charges by Smith, who was appointed a special counsel in November by U.S. Attorney General Merrick Garland.

Mr. Trump pleaded not guilty after a federal grand jury in Miami convened by the special counsel charged him in June in a 37-count indictment over his unlawfully retention of classified government documents after leaving office in 2021 and obstructing justice. Prosecutors accused him of risking some of the most sensitive U.S. national security secrets.

Last Thursday, prosecutors added three more criminal counts against Mr. Trump, bringing the total to 40, accusing him of ordering employees to delete security videos as he was under investigation for retaining the documents.

The first charges brought against Mr. Trump emerged in March when a grand jury convened by Manhattan’s district attorney indicted him. Trump in April pleaded not guilty to 34 felony counts accusing him of falsifying business records concerning a payment to porn star Stormy Daniels to buy her silence before the 2016 election about a sexual encounter she said she had with him. Trump has denied the encounter.

Mr. Trump, 77, leads a crowded field of Republican presidential candidates as he seeks a rematch with Biden, 80, next year. Biden in April launched his re-election campaign.

Mr. Trump, who served as president from 2017 to 2021, has shown an ability to survive legal troubles, political controversies and personal behavior that might sink other politicians. Many Republicans – elected officials and voters – have rallied behind Trump, portraying the charges against him as selective prosecution and a Democratic plot to destroy him politically.

Strategists said that while the indictments could help Mr. Trump solidify support within his base and win the Republican nomination, his ability to capitalize on them may be more limited in next year’s general election, when he will have to win over more skeptical moderate Republicans and independents.

Meanwhile, his legal woes are mounting. In addition to the three indictments, Mr. Trump faces a fourth criminal investigation by a county prosecutor in Georgia into accusations he sought to undo his 2020 election loss in that state.

Documents case

In the documents case, prosecutors accused him of mishandling sensitive classified documents about everything from the U.S. nuclear program to potential domestic vulnerabilities in the event of an attack.

When the Justice Department tried to get Mr. Trump to return the documents, the indictment alleges, he asked his attorneys if they could lie to the government about the existence of the records. He was accused of conspiring with his aide Walt Nauta, who is also charged, to move boxes containing documents around inside his home at the Mar-a-Lago resort in Florida to prevent them from being found. Nauta also has pleaded not guilty.

A second employee, a maintenance worker at Mar-a-Lago, Carlos De Oliveira, was charged on Thursday with conspiracy to obstruct justice, accused of helping Mr. Trump to hide documents.

A jury in federal court in Manhattan decided in May in a civil lawsuit that Mr. Trump must pay $5 million in damages for sexually abusing former Elle magazine columnist E. Jean Carroll in the 1990s and then defaming her by branding her a liar.

His real estate company was convicted in 2022 in Manhattan of tax fraud charges, though he personally was not charged in that case.

Special counsels are sometimes appointed to investigate politically sensitive cases and they do their jobs with a degree of independence from the Justice Department leadership.

Before being appointed by Garland to take over the two Trump-related investigations, Smith had served as the chief prosecutor for the special court in The Hague, tasked with prosecuting war crimes in Kosovo, oversaw the Justice Department’s public integrity section and worked as a federal and state prosecutor in New York.

Capitol attack

In the Jan. 6, 2021, rampage at the Capitol, Mr. Trump’s supporters used a variety of weapons including chemical sprays and riot shields to attack police and infiltrate the building, forcing lawmakers to flee for their lives. Five people died during and shortly after the chaos, while about 140 police officers were injured. Before the attack Trump told supporters in an incendiary speech near the White House to march to the Capitol and “fight like hell” to “stop the steal” of the election.

More than 1,000 people have been charged with crimes arising from the riot, including some who have been convicted of seditious conspiracy.

Mr. Trump and his allies lost a series of election-related lawsuits challenging the election results based on false claims of fraud. As his presidency wound down, Mr. Trump continued to push this false narrative, ignoring warnings from some of his White House advisers, former Attorney General William Barr and other officials that there was no evidence of widespread fraud.

A 2022 investigative report by a Democratic-led U.S. House of Representatives committee found that Mr. Trump “corruptly pressured” former Vice President Mike Pence to refuse to count the state-by-state electoral votes that determine an election’s outcome during a joint session of Congress.

As part of that alleged scheme, the committee said Mr. Trump and several of his advisers oversaw a plot to have electors in pivotal states where Mr. Trump lost – such as Arizona, Georgia, Michigan, New Mexico and Pennsylvania – to submit fraudulent documentation to Congress and the U.S. National Archives and Records Administration that he had actually won those states.

Crime Guy’s Lawyers Go To Justice Department To Say Hey, Don’t Charge Crime Guy With Crimes

A couple weeks ago, we all laughed and laughed at the dumbstupid letter Donald Trump’s lawyers sent to Attorney General Merrick Garland, respectfully begging for a meeting so they could explain that Special Counsel Jack Smith was a witch hunter doing witch hunts, and that Hunter Biden exists. It was widely interpreted as a sign that indictments were very soon coming in Smith’s BOXES HOAX, which is what Trump calls the investigation into why he stole all those classified state secrets and placed them inside his bottom so the FBI wouldn’t find them when they came calling.

It sounds like that meeting happened this morning, though apparently not with anybody as important as Garland. This was their meeting to explain that the Justice Department has it all wrong and Donald Trump is the purest of good men with only the best intentions, blah blah blah, innocent until suck my balls, or however it goes. Also CNN says they brought with them allegations of prosecutorial misconduct, so that’s amusing.

The Washington Post reports it was John Rowley and James Trusty, the two lawyers on that letter, plus Lindsey Halligan, another one of the idiots.

Trump was glad to hear the other day that Mike Pence would not be charged for the classified documents they found in his house, but demanded to know when he would be “fully exonerated” just like Pence was.

And then last night, it appears he was just hallucinating:

So he’s freaking the fuck out.

Meanwhile, this week the grand jury in the case is back and hearing more evidence, reports NBC News. And the New York Times has a story about how former Trump lawyer Evan Corcoran apparently made a long and detailed recording last year of his thoughts, feelings, recollections, and reflections on an entire month of the case. Prosecutors have this tape now, and it sounds pretty juicy:

In complete sentences and a narrative tone that sounded as if it had been ripped from a novel, Mr. Corcoran recounted in detail a nearly monthlong period of the documents investigation, according to two people familiar with the matter.

Mr. Corcoran’s narration of his recollections covered his initial meeting with Mr. Trump in May last year to discuss a subpoena from the Justice Department seeking the return of all classified materials in the former president’s possession, the people said.

It also encompassed a search that Mr. Corcoran undertook last June in response to the subpoena for any relevant records being kept at Mar-a-Lago, Mr. Trump’s private club and residence in Florida. He carried out the search in preparation for a visit by prosecutors, who were on their way to enforce the subpoena and collect any sensitive material found remaining there.

Uh yeah, we guess that sounds like it might be helpful evidence. Remember, in March, both DC District Court Judge Beryl Howell and an appeals court panel ruled that attorney-client privilege didn’t apply with Corcoran because of the crime-fraud exception, because of a reasonable belief Trump had lied to him about the location of certain classified documents. So that’s why Jack Smith has that. Boxes hoax, election interference, etc., and so forth.

The Times says Trump aides are scared of this one. “The level of detail in the recording is said to have angered and unnerved close aides to Mr. Trump, who are worried it contains direct quotes from sensitive conversations.”

Guess they’ll just have to keep worrying.

Appeals Court Agrees That Trump Too Crimey-Fraudy To Assert Privilege Over Lawyer’s Testimony

In the meantime, some very smart legal experts have put together a 186-page Model Prosecution Memo over at Just Security, taking all the publicly available evidence in BOXES HOAX and analyzing which crimes Trump could and should be indicted for. And to be clear, they think he’s going to be:

This model prosecution memorandum assesses potential charges federal prosecutors may bring against former President Donald Trump. It focuses on those emanating from his handling of classified documents and other government records since leaving office on January 20, 2021. It includes crimes related to the removal and retention of national security information and obstruction of the investigation into his handling of these documents. The authors have decades of experience as federal prosecutors and defense lawyers, as well as other legal expertise. Based upon this experience and the analysis that follows, we conclude that Trump should–and likely will–be charged.

Lock him up where we never have to listen to his face again.

If We Were Trump, We’d Be Sh*tting Our Big Ugly Golf Pants Over Jack Smith’s Investigation Right About Now

Donald Trump is in Ireland doing lazy ass shit probably, don’t know, don’t care, but he’s been real unhappy with how things have been going with E. Jean Carroll’s civil rape trial against him back in New York. So he got all cranky with reporters on his golf course over there yesterday and started blabbering for four solid minutes about how “I’m going to go back [to New York] and I’m going to confront this woman. This woman is a disgrace.” You betcha. He said he’s cutting his trip short. He doesn’t want to. He has to.

So pissy:

Trump said he was the victim of “false accusations against a rich guy. Or in my case against a famous, rich and political person that’s leading the polls by 40 points.”

Okeydoke, false accusations against a rich guy, or in his case a famous rich political person that’s leading the polls by 40 points. Uh huh. Cool.

After striking his shot, Trump claimed it had travelled about 280 yards. “Biden can’t hit it 80 down the middle,” he said.

OK. Is Trump actually coming to America to appear at the trial?

“No,” [Trump lawyer Joe] Tacopina responded when asked if Trump would appear in person.

Figured.

(Yesterday, the judge took the basically unprecedented step of giving Tacopina and Trump a little time to MAKE EXTRA CERTAIN they’re on the same page regarding whether Trump will testify. Mind you, Carroll’s lawyers have rested and Trump’s lawyers were just about to. So when he bitches about how UNFAIR BIASSSS this judge is against him, keep that in mind.)

But maybe Trump’s gonna have to make some empty threats to come confront Special Counsel Jack Smith, because the New York Times broke a bunch of news about all Smith’s criminal investigations into Trump and his pals last night.

Maggie Haberman and about 8,000 other reporters are bylined, so you know it’s full of words and news.


First thing!

In the classified docs investigation into why Trump stole state secrets and hid them under Eric’s spare floaties next to the pool at Mar-a-Lago, and why he obstructed efforts by the feds to get them back, Haberman and Co. report that they have a new confidential cooperating witness, somebody who has “worked for him at Mar-a-Lago,” which seems like interesting phrasing from the reporters. Just last month we were learning that there’s a major focus on whether Trump personally touched documents himself in an effort to pull things back and hide them after the feds demanded them in May 2022.

We’ve talked about Walt Nauta, Trump’s very loyal valet, who has done some testifying on this subject. Well, regarding Walt, who was apparently a real pain in the ass with investigators:

[P]rosecutors appear to be trying to fill in some gaps in their knowledge about the movement of the boxes, created in part by their handling of another potentially key witness, Mr. Trump’s valet, Walt Nauta. Prosecutors believe Mr. Nauta has failed to provide them with a full and accurate account of his role in any movement of boxes containing the classified documents.

What? A Trump loyalist being less than forthcoming, allegedly? We might need a minute to process.

Second thing!

Buncha new people being subpoenaed in that investigation. “At least four more Mar-a-Lago employees,” says the Times, using different phrasing from how they talked about the secret cooperating witness. According to their sources, that brings the count of Mar-a-Lago employees subpoenaed to pretty much ALL OF THEM KATIE. Also, a subpoena for “another person who had visibility into Mr. Trump’s thinking when he first returned material to the National Archives.” And some subpoenas for the Trump Organization for more surveillance tape. And Matthew Calamari, his head of security at the company, and Calamari’s son Little Matthew Calamari, who also does security stuff there.

So many subpoenas!

Also:

But hoping to understand why some of the footage from the storage camera appears to be missing or unavailable — and whether that was a technological issue or something else — the prosecutors subpoenaed the software company that handles all of the surveillance footage for the Trump Organization, including at Mar-a-Lago.

Oh dang. Funny how in these days of Internet Dot Com nothing really is ever all the way deleted. We imagine sometimes Boomers get to learn that the hard way. Womp womp.

Third thing!

Still talking about new subpoenas, but UH OH SKETTI OH, pretty sure this is a whole new wang to this investigation that we didn’t know about before:

One of the previously unreported subpoenas to the Trump Organization sought records pertaining to Mr. Trump’s dealings with a Saudi-backed professional golf venture known as LIV Golf, which is holding tournaments at some of Mr. Trump’s golf resorts.

It is unclear what bearing Mr. Trump’s relationship with LIV Golf has on the broader investigation, but it suggests that the prosecutors are examining certain elements of Mr. Trump’s family business.

Oh shit! It’s the Saudi stuff! Oh shit!

Well, since we have no idea how exactly that pertains to the investigation, we’ll just have to wait and see.

But oh shit!

Maybe Trump is just one of those guys where you’re investigating one set of crimes and then you don’t even mean to but you find some other crimes and it’s like huh what’s that?

Shut up, there’s no “maybe” about it, that’s exactly how it is.

Also remember that Jack Smith is also investigating Trump’s role in January 6 and his months-long campaign to overturn the election he lost and overthrow the government.

Lordy, Abby Grossberg Has Tapes!

The other evening, former Fox News producer Abby Grossberg, whose lawsuit may be a contributing factor for why Tucker Carlson was so unceremoniously fired Monday morning, started making the media rounds with her lawyer. (She thinks her lawsuit is probably a factor.) She appeared on MSNBC with Nicolle Wallace, and her lawyer showed up afterward on the same network’s Ari Melber show.

News, as they say, was made.

She talked about about how Tucker had made her life a “living hell,” and what a disgusting and misogynist place Tucker’s show was to work. (That’s all in her lawsuit.) She talked about how much Tucker liked to say the C-word, about women in general who made him mad, and especially about Sidney Powell, and how Fox News’s lawyers coached her to tell common lies about whether that bothered her. Indeed, she told Wallace that after she gave her original deposition in the Dominion lawsuit, the show threw a special lunch called “Abby Day” because they were so proud of her answers.

And she talked about how bizarrely and preternaturally obsessed Tucker was with making up and spreading conspiracy theories that the terrorist attack of January 6 was some kind of false flag perpetuated by the FBI. Even though lawyers for people on trial for invading the Capitol that day were begging him to stop.

That’s all at the end of this clip, which is quite a highlight reel of the full interview:


According to Grossberg, the now-former Fox News star was “very set on finding an FBI person who was implanted in the crowd” so he could prove the insurrection was a false flag by the government.

“[He was] spinning this conspiracy that they were ultimately the ones responsible for the Capitol attack, not Fox News as they’re about to go into the Dominion trial,” she said. “It was really the FBI that set up this thing, not Fox telling the American people that the election was rigged and the voting machines did it.” Grossberg claimed that even an attorney representing some of the Capitol rioters implored her to push Carlson away from the unhinged theory, but it was to no avail because “everyone was a believer” on the show.

“I went back to them and said, look, there’s no conspiracy theory here. I called the attorney who is representing one of the Proud Boys. He told me on two occasions, ‘There’s no conspiracy, get away from this stuff, this is dangerous. Tell Tucker to stop. I will come on your show, but I’ll absolutely walk off if he asks me this.’ And the result was, find somebody else, Tucker is really intent on this.”

It was bizarre how Tucker latched so quickly on to the idea that the January 6 terrorists were all innocents, and that an attack on them was an attack on all his viewers. And he knew exactly what the assignment was when Kevin McCarthy gave him all those tapes.

Oh well, thank goodness he can’t spew that nonsense to such a big audience night after night anymore.

Maybe he can get some cats and tell January 6 Was A Planned Demolition conspiracy theories to them in his Maine “Hee Haw” studio.

And Lordy, Her Tapes!

Grossberg really did record a lot.

She says she’s got 90 tapes, that she knows of, so far, so it’s definitely not just that Rudy Giuliani tape that came out just before the Dominion trial, where he admitted out loud to Maria Bartiromo that he didn’t have shit evidence for all his voter fraud lies.

In the clip below she explains that Fox News failed to turn over a whole lot of things she provided to them during discovery for the Dominion case, and doesn’t know whether it was intentional or reckless that they failed to turn them over to Dominion. Oh well, she found ’em now! She says she’s also gotten a subpoena in the Smartmatic case.

The next hour on Ari Melber’s show, where Grossberg’s lawyer was a guest, he played a big important tape of Ted Cruz on the phone with Maria Bartiromo on January 2, talking about denying certification of the election on January 6, then standing up a fake commission afterward to investigate all the fake frauds, then use that to overturn the result:

If the commission found “credible evidence of fraud that undermines confidence in the electoral results in any given state,” then the state would then call a special session and recertify results, according to Cruz.

“Is there any chance you can overturn this?” Bartiromo asked Cruz.

“I hope so,” he responded.

“Who gets inaugurated?” asked Bartiromo. Ted Cruz said hopefully the commission could figure all that out.

Watch that whole Melber report above to see how much Cruz was plotting. He was working hard to overthrow the government y’all!

Cruz is angrily sending out missives acting like this is all some “gotcha!” by MSNBC and insisting these were things he was saying in public at the time too. And yes, it is true that those plotting the coup were largely doing it in all our faces, because that’s what kind of craven, unpatriotic shitheels they are.

But it’s just another piece of the puzzle, and Abby Grossberg’s lawyer Gerry Flippatos has told Melber and other news media that he’s been in touch with Special Counsel Jack Smith, who is investigating the many-pronged plan to overthrow the government and steal the presidency from its rightful winner Joe Biden.

Have they given Smith all of Grossberg’s Lordy She Has Tapes, which include the ones we’ve mentioned, plus conversations between Maria Bartiromo and Sidney Powell and other Trump campaign people? Flippatos says they’ve talked to “numerous law enforcement agencies” about the tapes, and provided info about how they’ll deliver them:

“We have voluntarily surrendered to the relevant law enforcement agencies details regarding the approximately 90 Otter tapes in Miss Grossberg’s possession and have engaged in discussions with these law enforcement agencies to receive targeted subpoenas regarding any such tapes that may be of interest to them,” he said. Otter is an app that transcribes audio recordings and is popular with reporters and producers.

In summary and in conclusion, she recorded everything and they are ready and willing to help.

This weekend, the Biden administration continued being obscenely transparent about this and revealed that on Thursday, Biden White House lawyer Richard Sauber found a few MORE classified docs from Joe Biden’s Wilmington, Delaware, house. (This is batch three.) So of course they told us immediately, because they are good and they are well-behaved and when they find classified documents they always tell the teacher immediately!


Sauber found the document because Biden’s personal lawyers called him when they found that other classified doc next to the garage in Wilmington. So he went out there to help turn it over to the Justice Department. One thing led to another and they checked this other box, blah blah blah.

“Because I have a security clearance, I went to Wilmington Thursday evening to facilitate providing the document the President’s personal counsel found on Wednesday to the Justice Department,” Sauber said. “While I was transferring it to the DOJ officials who accompanied me, five additional pages with classification markings were discovered among the material with it, for a total of six pages. The DOJ officials with me immediately took possession of them.”

He added, “The President’s lawyers have acted immediately and voluntarily to provide the Penn Biden documents to the Archives and the Wilmington documents to DOJ.”

Again, this is what you should do in the unlikely event you ever find a document with classified markings in one of your piles of junk mail. Returning classified documents is easy and fun!

You don’t go on the radio and call the special counsel appointed to investigate a “terrorist” and paint a target on their family; you don’t lie and say you declassified those documents in your brain; you don’t baselessly insinuate that maybe the FBI/Deep State planted those documents, and you don’t lie to the National Archives and Justice Department to conceal the fact that you are still hiding a shitload more classified documents you stole.

None of this changes the fact that Kentucky Fried Pigshit Person Rep. James Comer, new chair of the House Oversight Committee, told Jake Tapper this weekend that he will be investigating Biden’s classified documents, but not Trump’s. Why? Refer to what we said about how Republicans are deeply unserious and deeply unwell, and add how they are where integrity goes to die.

Also remember that the entire thing James Comer is famous for is heavily breathing in frustration in November because reporters wouldn’t focus their questions on Hunter Biden. If we could keep this about Hunter Biden, OK? We think it’s pretty important to keep this about Hunter Biden! Hunter Biden!

Tapper played a clip of Comer saying in November that the Trump documents case would “not be a priority” for him, and asked:

“Do you only care about classified documents being mishandled when Democrats do the mishandling?” Tapper asked.

“Absolutely not,” Comer responded. He added, “At the end of the day, my biggest concern isn’t the classified documents, to be honest with you. My concern is how there’s such a discrepancy in how former President Trump was treated, by raiding Mar-a-Lago, by getting the security cameras, by taking pictures of documents on the floor, by going through Melania’s closet versus Joe Biden where its like — okay, your personal lawyers who don’t have security clearance, they can go through, they can just keep looking and keep looking and determine whatever is there. That’s not equal treatment, and we’re very concerned and there’s a lack of trust here at the Department of Justice by house Republicans.”

“Why was Mar-a-Lago raided, but the president’s home not?” asked Comer, as disingenuously as every other square-faced white-haired southern Republican who looks like he’s dressed in drag for a Young Newt Gingrich lookalike contest. He told Tapper that “With respect to investigating President Trump, there have been so many investigations of President Trump. I don’t feel like we need to spend a whole lot of time investigating President Trump because the Democrats have done that for the past six years.”

To which we reply oh go fuck yourself.

Also, if Comer moves those goalposts any faster he’s going to poke somebody’s eye out.

All these questions have been asked and answered. Gallants who cooperate in every way are treated with respect. Goofuses who lie and obstruct investigations get their asses raided. It’s real fuckin’ simple. And if Melania has to buy new underpants, well, Wonkette has already done the journalistic work of finding out where the closest Walmart to Mar-a-Lago is.
