Ex-Trump lawyer Giuliani ordered to pay $148 million in damages for defaming Georgia poll workers

A jury awarded $148 million in damages on Friday to two former Georgia election workers who sued Rudy Giuliani for defamation over lies he spread about them in 2020 that upended their lives with racist threats and harassment.

Issued on: Modified:

4 min

The damages verdict follows emotional testimony from Wandrea “Shaye” Moss and her mother, Ruby Freeman, who tearfully described becoming the target of a false conspiracy theory pushed by Giuliani and other Republicans as they tried to keep then-President Donald Trump in power after he lost the 2020 election.

There was an audible gasp in the courtroom when the jury foreperson read aloud the $75 million award in punitive damages for the women. Moss and Freeman were each awarded another roughly $36 million in other damages.

“Money will never solve all my problems,” Freeman told reporters outside Washington’s federal courthouse after the verdict. “I can never move back into the house that I call home. I will always have to be careful about where I go and who I choose to share my name with. I miss my home. I miss my neighbors and I miss my name.”

Giuliani didn’t appear to show any emotion as the verdict was read after about 10 hours of deliberations. Moss and Freeman hugged their attorneys after the jury left the courtroom and didn’t look at Giuliani as he left with his lawyer.

The former New York City mayor vowed to appeal, telling reporters that the “absurdity of the number merely underscores the absurdity of the entire proceeding.”

“It will be reversed so quickly it will make your head spin, and the absurd number that just came in will help that actually,” he said.

It’s not clear whether Giuliani will ever be able to pay the staggering amount. He had already been showing signs of financial strain as he defends himself against costly lawsuits and investigations stemming from his representation of Trump. In September, his former lawyer sued him, alleging Giuliani had paid only a fraction of nearly $1.6 million in legal fees he racked up.

His attorney in the defamation case told jurors that the damages the women were seeking “would be the end of Mr. Giuliani.”

Giuliani had already been found liable in the case and previously conceded in court documents that he falsely accused the women of ballot fraud. Even so, the former mayor continued to repeat his baseless allegations about the women in comments to reporters outside the Washington, D.C., courthouse this week.

Giuliani’s lawyer acknowledged that his client was wrong but insisted that Giuliani was not fully responsible for the vitriol the women faced. The defense sought to largely pin the blame on a right-wing website that published the surveillance video of the two women counting ballots.

Giuliani’s defense rested Thursday morning without calling a single witness after the former mayor reversed course and decided not to take the stand. Giuliani’s lawyer had told jurors in his opening statement that they would hear from his client. But after Giuliani’s comments outside court, the judge barred him from claiming in testimony that his conspiracy theories were right.

The judgment adds to growing financial and legal peril for Giuliani, who was among the loudest proponents of Trump’s false claims of election fraud that are now a key part of the criminal cases against the former president.

Giuliani is still facing his biggest test yet: fighting criminal charges in the Georgia case accusing Trump and 18 others of working to subvert the results of the 2020 election, won by Democrat Joe Biden, in that state. Giuliani has pleaded not guilty and characterized the case as politically motivated.

Jurors in the defamation case heard recordings of Giuliani falsely accusing the election workers of sneaking in ballots in suitcases, counting ballots multiple times and tampering with voting machines. Trump also repeated the conspiracy theories through his social media accounts. Lawyers for Moss and Freeman, who are Black, also played for jurors audio recordings of the graphic and racist threats the women received.

On the witness stand, Moss and Freeman described fearing for their lives as hateful messages poured in. Freeman described strangers banging on her door and recounted fleeing her home after people came with bullhorns and the FBI told her she wasn’t safe. Moss told jurors she tried to change her appearance, seldom leaves her home and suffers from panic attacks.

“Our greatest wish is that no one, no election worker, or voter or school board member or anyone else ever experiences anything like what we went through,” Moss told reporters after the verdict. “You all matter, and you are all important.”

Defense attorney Joseph Sibley had told jurors they should compensate the women for what they are owed, but he urged them to “remember this is a great man.”

An attorney for Moss and Freeman, in his closing argument, highlighted how Giuliani has not stopped repeating the false conspiracy theory asserting the workers interfered in the November 2020 presidential election. Attorney Michael Gottlieb played a video of Giuliani outside the courthouse on Monday, in which Giuliani falsely claimed the women were “engaged in changing votes.” Giuliani kept pressing false election claims even after the verdict, telling reporters, “I know my country had a president imposed on it by fraud.”

“Mr. Giuliani has shown over and over again he will not take our client’s names out of his mouth,” Gottlieb said. “Facts will not stop him. He says he isn’t sorry and he’s telegraphing he will do this again. Believe him.”

The judge overseeing the election workers’ lawsuit had already ordered Giuliani and his business entities to pay tens of thousands of dollars in attorneys’ fees. In holding Giuliani liable, the judge ruled that the former mayor gave “only lip service” to complying with his legal obligations while trying to portray himself as the victim in the case.

Has James Comer Just Been Begging FBI To Let Him Sniff Rudy’s Russian Spy Farts This Whole Time?

Peruse if you will a few video clips.

Republican Senator Chuck Grassley is “not interested in whether the allegations against Vice President Biden are accurate or not.”

He’s not interested in whether the allegations are accurate or not.

But isn’t there a document at the FBI? Hasn’t Chuck Grassley seen it? Doesn’t it say Joe Biden did a buncha bads? “Let’s put it this way, there are accusations in it,” said Grassley on Fox News this morning.

YOU BETCHA.

But what about the FORMMMMMMM? Haven’t Grassley and House Oversight Committee Banjo Deliverance Moron Dumbfuck Pork-Brained Idiot James Comer been saying the FBI has a FORRMMMMMMMMMMM? And doesn’t FORRRRRRMMMMMMMMMMMMMMMMMMMMMMM say that Joe Biden did a stinky in a place with a people and a thing?

Comer has been presenting pretty hard evidence that Joe Biden did a stinky in a place with a people and a thing! (Jingle jangle dingle dangle banjo banjo STRUM!) And as soon as he finds some a-them whistleblower informant thingies he’s lost, he’s gonna blow this Biden scandal wide open! (Time for singin’, time for jokes! Gather ’round and join us, folks! Hee-hee! Hee-haw-haw! Hee-hee! Hee-haw-haw!)

James Comer Knows What Joe Biden Did! Party’s Over, Joe! Resign Before He Tells Everybody What You Did!

James Comer NAILS! Biden For Maybe Knowing About Possible Schemes His Family Coulda Done With Perhaps China?

Oh No, What Is Joe Biden Doing To James Comer’s Informants Who Are Definitely Real And Not Imaginary?

Well, Comer explained yesterday that he had a call with FBI Director Christopher Wray, and Comer said Wray told him there is a form, and the form says a thing, but Wray won’t give him the form, the form what says the thing. And NOOOOOW? Now Comer gonna have to do CONTEMPTS to Chris Wray! (Yeeeee HAW! It’s time for a hoedown!)

Wray offered to let him see the form, though.

We have been making fun of James Comer and Chuck Grassley, but mostly James Comer, for quite a while about his pathetic investigations. He’s just a devastatingly stupid man. And he cannot seem to keep himself from standing in front of TV cameras and telling us how stupid he is. We can’t even keep up with it. Every five seconds it seems like he’s on TV, admitting accidentally that his loser clown probes into Hunter Biden’s penis are simply meant to hurt Joe Biden. (Remember when Kevin McCarthy did thatvis à vis Hillary and Benghazi? Guess who’s stupider than Kevin McCarthy.)

Well listen.

We have a surprise, and it is that the document that James Comer is huffing paint about, the one he’s just been pretty sure the FBI has, is one of the paint-huffing documents Rudy Giuliani gave the FBI back in 2020. Remember that? Back when Rudy would go to Ukraine, get some documents from Russian spies, and then come back to America and pull them out of his underpants and try to get then-attorney general Bill Barr to smell them? Yeah those.

Bill Barr was so impressed with Rudy Giuliani’s “evidence” that he got a US attorney in western Pennsylvania named Scott Brady to handle the very important task of sifting through the “Ukraine evidence” on the Bidens provided by Giuliani. Literally everything Rudy had to share about the Bidens was a bath salts-grade conspiracy theory, and yes, some it came from the Kremlin, and it had all been roundly debunked.

In other words, Barr stuffed this shit in Pittsburgh because it was too stupid even for him to deal with.

That’s apparently where this document came from that Comer’s got his farm dog lipstick out about. Does this mean Rudy’s wet farts are James Comer’s “informant” and/or “whistleblower”? LMAO. Kinda sounds like it.

More from Zachary Cohen’s reporting:

In short, the document is probably almost certainly not true, could very well be Russian disinformation, but James Comer doesn’t care. He’s just trying to hurt the Bidens, as he’s accidentally admitted.

Rudy didn’t care if he was colluding with Russian spies before the 2020 election, but he was pretty sure his dirt on the Bidens was true anyway, because obviously. Rudy and GOP Senator Ron Johnson blew off defensive briefings from the FBI trying to tell them that there were Russian spies crawling up their pantlegs. They didn’t care.

Rudy And Ron Johnson Blew Off FBI Warnings About Russian Spies Because PFFFFFFFT DEEP STATE!

Rudy Giuliani: Americans Deserve To Hear My Easily Debunked Russian Spy Lies!

This is all the same goddamned fucking story, over and over and over and over again. it’s the same story Donald Trump was impeached for, when he tried to force Ukraine to help him steal the election. It’s the same story, ever since Russian spies started shoving this shit down Trump people’s pants back in 2018 or so. And that story connects to the story of Russia helping Trump “win” the 2016 election.

And now James Comer is back at the same trough, seeing what he can slurp out of it.

Here, piggy piggy.

Josh Hawley Finds A Hate Crime He Cares About

Following Monday’s horrific mass shooting at a private school in Nashville, Tennessee, the rightwing outrage machine has finally decided America needs to do something about gun violence. Just kidding, they’d rather ignore the guns and continue escalating panic over transgender people to even greater levels.

Among the few things we know about the shooter, Audrey Hale, who was killed by police just 15 minutes after the attack began, is that Hale was a former student of the school, that Hale had in recent months begun identifying online as transgender, using he/him pronouns in a LinkedIn account, and that police found some writings in Hale’s house that they’re calling a “manifesto,” although whatever that constitutes hasn’t yet been released.

That was all rightwing media and politicians needed to know to proclaim not only that Hale was motivated by being trans, but also that Hale absolutely hated Christianity and Christians, because after all, the target was a Christian school. Lost in that certainty, of course, is the detail that Hale had attended that very school as a child. Therefore, like many school shooters, Hale was attacking a familiar target.

The New York Post‘s very responsible front page yesterday screamed a bunch of stuff that there’s no actual evidence for, all mostly based on unfounded speculation. It proclaimed, “TRANSGENDER KILLER TARGETS CHRISTIAN SCHOOL,” implying both that Hale’s being trans was the reason for the attack, and that their motive was to attack Christians, neither of which we actually know enough to say yet. The subhed made it even more bizarre, stating that “‘Manifesto’ leads to 6 dead, including three young kids.” These manifestos are pretty deadly things!

As The Nation’sElie Mystal points out,

The “manifesto” did not “lead” to six dead people. The two assault rifles and handgun the shooter brought with them led to six dead people. If the shooter had shown up to school armed with a manifesto, everybody would still be alive.

The people writing headlines for the Post are probably evil, but they’re not stupid. They know exactly what they’re doing. […]

As is usual for places where conservatives get their media, the Post takes real problems and inverts them to fit the white grievance narrative.

And so, as always, white Christians are justified in whatever fears they want to project on the despised minority, because for once, unlike in 98 percent of mass shootings, the shooter was not a cisgender white male with a gun. The killer was a trans person. With three guns, all of them purchased legally. (Part, we now know, of a seven gun arsenal Hale had purchased over the last few years.)

Evan has already looked at the insane persecution ravings of Marjorie Taylor Greene and Tucker Carlson, both of whom are equally certain that the school shooting portends a coming wave of trans people attacking innocent Christians. But Sen. Josh Hawley (R- Missouri), the culture warrior who frets about how feminists are stealing men’s masculinity and hiding it in clever wooden boxes they buy on Etsy, yesterday went beyond mere rabble-rousing. Hawley sent a letter to FBI Director Christopher Wray and Homeland Security Secretary Alejandro Mayorkas to demand that the Nashville shooting be investigated as a “hate crime,” because if someone shoots up a church school, the shooter must hate Christianity. That’s just logic.

Hawley, based on a police statement that the school had been “targeted,” added his own spin, going beyond anything police have actually said. Police have not yet identified a motive for the shootings, beyond saying it appears that Hale may have felt “some resentment for having to go to that school.”

“It is commonplace to call such horrors ‘senseless violence,'” Hawley wrote, adding his very own explication that “properly speaking, that is false. Police report that the attack here was ‘targeted’ — targeted, that is, against Christians.” Which, again, police didn’t say. (Is pointing that out three times enough?)

And yes, Josh Hawley knows damn well that the standard for a hate crimes prosecution is higher than “it happened at a church school, so it was a hate crime aimed at Christians.”

Hawley’s letter cited the federal hate crimes statute, emphasizing that it includes religion-based violence, and stretched the little we know so far to come to the conclusion that the shooting had to be a hate crime, even though so far police haven’t released Hale’s writings or said anything more than that suggestion that Hale felt “resentment” toward the school. Maybe it was religious resentment, sure. Or maybe it wasn’t. But before we know any of that, Hawley wants the “full resources” of federal law enforcement thrown at investigating the attack, not only to discover the motive, but also to find out “who may have influenced the deranged shooter to carry out these horrific crimes.” Wouldn’t it be great to blame people in the LGBTQ+ rights movement, or maybe some militant atheists?

Hawley closed by solemnly stating, “Hate that leads to violence must be condemned. And hate crimes must be prosecuted.” That seems like a pretty commonplace thought, until you’re reminded that in 2021, when Asian Americans were being targeted for hate crimes during the pandemic, Hawley was the only senator to vote against a resolution calling for expedited review of those crimes by the DOJ.

At the time, Hawley warned that there was no reason to turn the “federal government into the speech police,” and also fretted about letting the government have “sweeping authority to decide what counts as offensive speech and then monitor it.”

But come now, that bill was clearly an attack on Donald Trump for calling COVID-19 the “China Virus” and the “Kung Flu,” and Donald Trump’s words are by definition not hateful, why would you even suggest such a thing?

Checks & Imbalances: Feds Investigate ByteDance, AOC Is Hiring

Today we look at an investigation into ByteDance, a job opening with the Ocasio-Cortez campaign and tech leaders’ efforts to get a bailout for Silicon Valley Bank.

The FBI And DOJ Are Investigating ByteDance’s Use Of TikTok To Spy On Journalists

“The FBI and the Department of Justice are investigating the events that led TikTok’s Chinese parent company, ByteDance, to use the app to surveil American journalists, including this reporter, according to sources familiar with the departments’ actions,” reports Emily Baker-White:

According to a source in position to know, the DOJ Criminal Division, Fraud Section, working alongside the Office of the U.S. Attorney for the Eastern District of Virginia, has subpoenaed information from ByteDance regarding efforts by its employees to access U.S. journalists’ location information or other private user data using the TikTok app. According to two sources, the FBI has been conducting interviews related to the surveillance. ByteDance’s use of the app to surveil U.S. citizens was first reported by Forbes in October, and confirmed by an internal company investigation in December.

“We have strongly condemned the actions of the individuals found to have been involved, and they are no longer employed at ByteDance. Our internal investigation is still ongoing, and we will cooperate with any official investigations when brought to us,” said ByteDance spokesperson Jennifer Banks. TikTok did not respond to a request for comment.

50 Tech Leaders Circulated A Private Memo In Washington Calling For Action On SVB

“As SVB careened towards catastrophe, some 50 founders, VCs, economists and comms experts gathered in a WhatsApp group to draft a memo calling for urgent preservation of its deposits for the sake of the broader economy. Then they sent it to Washington,” reports Alex Konrad.

Just after 5:30 pm Pacific on Saturday, a memo started making the rounds among policymaker staff. Called “United States Cascade Bank Failure Scenario,” the private document laid out the case for why the U.S. government needed to take “decisive action” to avoid a continued bank run in the wake of the abrupt closure of Silicon Valley Bank.

“Today, most Americans assume the SVB failure is contained to the tech economy, but this is not true,” the document said, before laying out a primer on how SVB collapsed and the dire consequences for inaction — insolvency for regional banks, massive job cuts and the loss of banking services for wide swaths of the country, far from Silicon Valley. “The risks to the U.S. economy could be sudden, severe, and extensive,” it warned.

Whereas some prominent voices in tech took to Twitter for all-caps concern tweets, the memo was unsigned, but it was authored by a coterie of almost 50 leaders within and beyond the tech ecosystem. From Thursday through the weekend, they crowd-sourced information and coordinated ad hoc outreach to staffers in the California governor’s office, the White House, and to lawmakers like Ro Khanna, Katie Porter, Elizabeth Warren and JD Vance.

AOC Searching For New Campaign Manager After Previous One Blamed For Met Gala Fiasco

Rep. Alexandria Ocasio-Cortez is looking for a new campaign manager after her previous one was blamed for dropping the ball on payments related to her Met Gala appearance. That lapse led the House ethics office to find “substantial reason to believe” the congresswoman violated ethics laws by “accept[ing] impermissible gifts.”

In September 2021, the New York Democrat attended the Met Gala, famously wearing a white dress with “Tax the Rich” scrawled across the backside. That appearance led the nonpartisan Office of Congressional Ethics to launch an investigation. Its inquiry discovered that Ocasio-Cortez did not pay for her dress, hair styling, makeup and other services until after the investigation was launched, five months after the gala.

Ocasio-Cortez told investigators she planned to personally pay for those services and had authorized her campaign manager to coordinate payments with the vendors, according to a transcript of her interview. “I continued to follow up on this thing because it was stressing me out, and I genuinely do not know what had happened,” Ocasio-Cortez said. “I had continued to get this kind of holding pattern response [from her campaign manager].”

“I just never, ever, ever would have allowed that to happen knowing what I have learned, but that I wasn’t privy to the invoices,” the congresswoman said.

The campaign manager, who was still employed by Ocasio-Cortez at the time of her interview in May 2022, provided investigators with a similar account. The campaign manager said she didn’t pay for the dress as she didn’t think the invoice was final. She didn’t pay for the hairstylist until after it threatened to file a complaint with New York City’s Office of Labor Policy and Standards for Workers because the bill “fell off my radar,” and she didn’t have access to the congresswoman’s personal credit card. Overall, the campaign manager said, “other things kind of took precedence.”

The campaign manager’s name is not included in the transcripts, but other exhibits included in the investigation’s report identify her as Rebecca Rodriguez.

“The staffer is no longer with the campaign,” said Communications Director Lauren Hitt in a statement, declining to explain if the ethics investigation led to the split. Forbes was unable to reach Rodriguez for comment.

Ocasio-Cortez began looking for a new campaign manager on or before Feb. 7, according to the first date Google indexed the posting. Responsibilities for the position, which pays $120,000 to $165,000 a year, include “partnering with the candidate to design and oversee the campaign strategy, set and execute priorities, and manage a skilled team of staff, advisors, consultants, and volunteers in a community-focused, unconventional year-round campaign operation.”

Overseeing compliance is another responsibility. The ad does not mention that duty may include ensuring Ocasio-Cortez’s hairstylist receives prompt payments.

Tracking Trump

A musical collaboration between Donald Trump and a choir of individuals incarcerated for their alleged involvement in the Jan. 6 riot sold 22,500 digital downloads in the 11 days after its release, according to a music analytics firm.

“Justice for All” by Trump and the J6 Prison Choir debuted on March 3. The track interpolates the former president reciting the Pledge of Allegiance into “The Star-Spangled Banner,” sung by inmates housed at the Washington, D.C. jail. Trump is personally involved in the project.

By the following Friday, the track reached the top spot on the iTunes Store, which measures how many times a song was purchased. Through that day, the song had sold 4,800 digital downloads across iTunes and other retailers, according to the tracking service Luminate (formerly known as Nielsen). The track has remained on the top spot with digital downloads totaling 22,500 through Monday. “That strikes me as a substantial amount of downloads,” said an executive in the music-technology business not associated with the release, who asked not to be named given the contentious nature of the song.

The music executive noted that consumers have moved away from downloading songs, opting instead to stream them. “Justice for All” was streamed on-demand 600,000 times across audio and video between March 3 and March 13, according to Luminate. “That’s not a ton,” said the music executive. “You often see a song that really takes off get millions and millions of streams in the first few days. That’s less impressive than the downloads.” That play count was not enough for “Justice for All” to land on Apple Music or Spotify’s streaming charts.

The song also has not reached Billboard’s charts. But Erica Knight, a spokesperson for Kash Patel, a former Trump administration staffer who is involved with the recording, said she expects to see the song on multiple charts when they are released next week.

Sales of a $100 vinyl version are “significant,” Knight claimed, declining to provide actual sales figure.

“Justice for All” costs $1.29 on the iTunes Store. Profits are slated to benefit the families of people imprisoned for their alleged roles in the Capitol riot.

Russian Oligarch Oleg Deripaska May Have Probed Vladimir Potanin Using Ex-FBI Agent Who Was Thorn In Trump’s Side

The indictment alleges that Deripaska retained a former FBI agent and a former Russian diplomat to investigate the assets of a rival oligarch, which Forbes found likely refers to Vladimir Potanin, Russia’s second-richest person.

Last Monday, the U.S. Department of Justice dropped a bombshell when it indicted a former FBI agent and a former Russian diplomat and interpreter on charges of money laundering and violating sanctions to help sanctioned Russian oligarch Oleg Deripaska. The 21-page indictment reads like the script of a mobster flick: the defendants refer to their sanctioned client as “our friend from Vienna,” “you know whom” and “the big guy.”

But the most striking allegation is that Deripaska sought to retain the former special agent, Charles McGonigal, and the former diplomat, Sergey Shestakov, to conduct an investigation into another, unnamed Russian oligarch with whom Deripaska was “contesting control over” a “large Russian corporation” in the spring of 2021. The effort allegedly involved looking into the rival oligarch’s assets outside of Russia and the possibility that he held another passport besides his Russian one.

A person familiar with the situation told Forbes that “probably [the oligarch] is Vladimir Potanin.” Vladimir Potanin is one of Russia’s richest people with an estimated $27.5 billion fortune. The “Russian corporation” likely refers to Norilsk Nickel, one of the world’s largest producers of nickel and palladium, also known as Nornickel.

“Deripaska was collecting materials to file a lawsuit in London [against Potanin] in order to force a new shareholder agreement for Norilsk Nickel to be concluded on the same terms,” the person added. A representative for Deripaska did not immediately respond to a request for comment.

It’s not the first time that Deripaska and McGonigal have been in the spotlight: They were both involved in the FBI investigation into the contacts between Russia and Donald Trump‘s 2016 presidential campaign. An FBI deputy assistant director stated in 2020 that an email from McGonigal in 2016 regarding Trump campaign advisor George Padadopoulos’ claims to have “political dirt” on Hillary Clinton helped spark the Trump-Russia investigation, while the FBI reportedly attempted to recruit Deripaska as a potential informant, given that he had previously employed Paul Manafort, Trump’s former campaign chairman, as an adviser. In a post on his Truth Social platform on Tuesday, Trump said of McGonigal: “May he Rot In Hell!”

Starting in 2018, the indictment alleges, McGonigal began working with Shestakov and an “employee and agent of Deripaska” cited as “Agent-1.” The indictment lays out the lengths to which McGonigal and Shestakov allegedly went to dig up dirt on the rival oligarch. The effort began in August 2021, when the two defendants, working with “Agent-1,” drafted and executed a contract with a Cyprus corporation that would in turn pay a New Jersey-based firm—owned by a friend of McGonigal—$41,790 a month and $51,280 upon execution of the contract for “business intelligence services, analysis, and research relevant to the [Russian corporation], its business operations and shareholders.” Between August and November 2021, the New Jersey-based firm received a total of $218,440 in payments wired from a Russian bank, according to the indictment.

As part of the investigation, McGonigal allegedly retained a subcontractor to carry out a “soup to nuts” investigation of the oligarch and the Russian corporation. In October 2021, the subcontractor told McGonigal that a third party had located “dark web” files that revealed “hidden assets valued at more than $500 million” and “other information that McGonigal believed would be valuable to Deripaska.” The indictment further alleges that McGonigal and Shestakov negotiated with “Agent-1” to obtain funds from Deripaska to purchase the dark web files between late October and late November 2021; FBI special agents seized their personal electronic devices on November 21, 2021.

The feud between Deripaska and Potanin dates back to April 2008, when Deripaska’s Rusal purchased a 25% stake in publicly traded Nornickel from Russian billionaire Mikhail Prokhorov in a cash-and-stock deal—estimated to be worth $14 billion—that included giving Prokhorov a 14% stake in Rusal. Prokhorov was Potanin’s original partner in Nornickel, with the two men cofounding banking group Oneximbank in 1993 and later acquiring Nornickel through the infamous loans-for-shares scheme in the 1990s—an arrangement in which Potanin and other businessmen provided financial backing for the reelection campaign of Russian president Boris Yeltsin, in return for stakes in state-owned energy and commodities assets obtained at bargain prices if Yeltsin won. (He did.)

Soon after the 2008 deal closed, Deripaska and Potanin clashed over Potanin’s influence over Nornickel’s board, the company’s share buyback plan and purchases of assets from Potanin’s Interros. They first reached a truce that December, when Rusal dropped its legal claim against Nornickel over the company’s share buyback. But the battle had flared up again by August 2010, when Rusal filed a request for arbitration against Potanin’s Interros in the London Court of International Arbitration and launched a website named “Save Norilsk Nickel” the following month.

Another Russian oligarch, Roman Abramovich, stepped in two years later to cool the tensions. He and his partners, fellow billionaires Alexander Abramov and Alexander Frolov, purchased a 6% stake in Nornickel for $1.5 billion in December 2012. Abramovich, Potanin and Deripaska then agreed to form a board with Potanin and Deripaska nominating four members each plus one for Abramovich. The deal, set to last for a decade (it expired on January 1, 2023), also kept Potanin as Nornickel’s CEO and committed Nornickel to a new dividend policy.

But the deal came under strain in 2018, when Potanin attempted to buy part of Abramovich’s shares in Nornickel—a move challenged by Rusal and halted by a London court in June 2018. Abramovich later sold some of his stake to Potanin in early 2019. By August 2020 Potanin was calling the agreement a “relic of the past” in an interview with Reuters.

Things appeared to have calmed down by April 2021, when Rusal stated it was “satisfied” with a decision by Nornickel’s board to buy back shares worth $2 billion. It was around that same time, the U.S. indictment alleges, that Deripaska had begun to seek an investigation into his rival oligarch in the spring of 2021. For his part, Potanin began expanding his empire after Russia’s invasion of Ukraine last February, re-purchasing Russian banking group Rosbank from French firm Société Générale last April and snapping up Russian bank Tinkoff Bank two weeks later, both for undisclosed amounts.

As recently as last July, Potanin was publicly musing about a potential $60 billion merger between Rusal and Nornickel, months before the January 1, 2023 expiration date of the 2012 agreement. But it became a non-starter after Potanin was sanctioned by the U.S. on December 15, 2022. Deripaska had already been sanctioned by the U.S. in April 2018. (Both men have also been sanctioned by the U.K., but the EU has only sanctioned Deripaska while leaving Potanin untouched—potentially due to Europe’s dependence on Nornickel’s nickel and palladium exports.)

The latest salvo in the Deripaska-Potanin fight came on October 21, when Rusal filed a lawsuit in London’s High Court against Potanin. “Rusal’s claims are based on Mr. Potanin’s failure to fulfill his duties as Norilsk Nickel’s managing partner and CEO,” Rusal said in a statement announcing the lawsuit. “Under the management of Mr. Potanin, Norilsk Nickel lost a number of assets that played a key role in [the] group’s activities. This resulted in Norilsk Nickel and its shareholders suffering significant losses.” (Potanin owns 37% of Nornickel through his investment holding company Interros, while Deripaska has a 45% stake in publicly traded En+ Group, which in turn owns 26% of Nornickel plus 57% of Rusal.)

In the statement, Rusal also claimed that it “continuously tried to enter in constructive dialogue with Mr. Potanin for an out-of-court settlement” but “these attempts have been unsuccessful.”

Whether that “constructive dialogue” includes Deripaska’s alleged illegal investigation of Potanin’s assets or not, the war between the two oligarchs shows no signs of fading away.

Will THIS GUY Expose Hillary’s FBI Conspiracy To Steal Election From Herself To Frame Trump For Russia Stuff?

Here’s an interesting story to know about, against the backdrop of new House Barely Speaker Kevin McCarthy caterwauling about how Adam Schiff LIEEEEED TO THE AMERICAN PEOPLE about Donald Trump’s collusion with Russia and TREEEEASON PARAPHRASED Trump’s very perfect call with Ukrainian President Volodymyr Zelenskyy, back in more innocent days when Trump was just extorting Ukraine to help him steal the 2020 election in exchange for protection from Russia.

Goddamn, that impeachment seems so much simpler to explain these days, don’t it?

The former top intelligence guy for the FBI’s New York field office, Charles McGonigal, has just been charged in federal courts in both DC and Manhattan with a number of very interesting crimes. For example, after he left the FBI, secretly working for Russian oligarch Oleg Deripaska investigating a rival oligarch, and also working on Deripaska’s behalf to get him off the US sanctions list, itself a violation of the sanctions. Also hiding $225,000 in other bribes from a different dude while he was working at the FBI.

So that’s weird, yeah?

Charles McGonigal, 54, who retired from the FBI in September 2018, was indicted in federal court in Manhattan on charges of money laundering, violating U.S. sanctions and other counts stemming from his alleged ties to Deripaska, an ally of Russian President Vladimir Putin. In his role at the FBI, McGonigal had been tasked with investigating Deripaska, whose own indictment on sanctions-violation charges was unsealed in September.

A second indictment, filed in Washington, accused McGonigal of hiding payments totaling $225,000 that he allegedly received from a New Jersey man employed decades ago by an Albanian intelligence agency. The indictment also accused him of acting to advance that person’s interests.

It seems bad for one of the former top intelligence guys at the FBI to be indicted for taking secret bribes and secretly working for the interests of one of Russia’s most powerful oligarchs, yeah? Especially one of the closest oligarchs to Vladimir Putin, Paul Manafort’s former boss, who was seemingly very close to the Russian operation to steal the 2016 election? Is that bad? Paul Manafort, of course, ran the Trump campaign, and pretty much every Russia report produced by the US government has concluded that he was integral to the NO COLLUSION!

Oh, and what was Manafort’s previous work for Deripaska? Propping up pro-Russian forces in Ukraine.

Trump Goon Paul Manafort Made $10 MILLION A YEAR To ‘Benefit Putin.’ Totally Normal!

It’s Manafort. It’s Always Been Manafort. And The Senate Intel Committee Seems To Agree!

NO COLLUSION! NO COLLUSION! You Know, Except For ALL THIS F*CKING COLLUSION!

Hey, Paul Manafort! Remember All That Shit You Pulled To Sell The World On The Ukrainian Dictator? Robert Mueller Remembers!

Most of the regular news reporting on this is extremely dry and weeds-y and virtually unreadable to anyone who isn’t obsessed with this stuff, but this excerpt about McGonigal, way down at the bottom of the Washington Post‘s article, is some extremely important context we will briefly explore:

McGonigal was an expert on Russian intelligence activities targeting the United States, as well as U.S. efforts to recruit Russian spies, said several former intelligence officials who worked with him and spoke on the condition of anonymity to describe sensitive matters.

His position at the New York field office would have given him direct access to past and current recruitment efforts, work that was coordinated with the CIA, these people said. McGonigal was well-known at the CIA among officers who dealt with Russia and counterintelligence matters, and he knew the details of some intelligence operations targeting Russia, former officials said.

McGonigal has not been charged with espionage, but the former officials who worked with him said his knowledge and experience would have put him at high risk of being recruited by a foreign government.

Rightwing weirdos are already pretty sure this guy — this guy! Not the last guy or the guy before that, this guy! — will be the key to unraveling the Deep State conspiracy where Hillary Clinton colluded with Russia and the FBI in order to steal the election from herself for the sole purpose of destroying the life and presidency of God-fearing patriot and humble servant Donald Trump. They are pointing to the fact that in 2016, he was head of Cybercrimes at the home office in DC, and was one of the first people who knew about allegations from Trump campaign idiot George Papadopoulos that the Russians had big dirt on Hillary that they were going to deploy against her.

Trump himself is raaaaaaaging over McGonigal’s arrest on Truth Social:

“The FBI guy after me for the Russia, Russia, Russia HOAX, long before my Election as President, was just arrested for taking money from Russia, Russia, Russia,” Trump wrote on his Truth Social platform on Tuesday. “May he Rot In Hell!”

Yeah OK, buddy, mash your meds up in some ketchup and swallow them.

What’s more interesting to us is what happened later in 2016, closer to the election.

As Heather Cox Richardson explains, October of 2016 was when then-FBI Director James Comey moved McGonigal into that position as head of counterintel at the New York field office. And what was happening in October of 2016, specifically regarding the New York FBI field office? That was the one that was as intent on skullfucking the Clinton campaign as Russia was, the one that seemed to be leaking fake bullshit about Clinton to Rudy Giuliani, who was babbling on the radio that the FBI was going to “revolt” if she wasn’t indicted.

Fox News was cumming itself at the time screaming that Hillary’s indictment was coming, apparently sourced from some dumb bucktoothed idiot types at the New York office who were furious Main Justice wouldn’t sanction their investigation into the Clinton Foundation, since it was based on debunked, Breitbart-funded bullshit from that dumb Clinton Cash book.

As Cox Richardson reminds us, when James Comey went before Congress in 2018, he said he was worried that if he didn’t blabber forth 11 DAYS BEFORE THE ELECTION about the “re-opening” of the Hillary emails investigation, after some “new” (not new) emails were found, that the New York office would leak it. And more:

Former acting attorney general Sally Yates was clearer. She told the inspector general that Comey and other FBI officials “felt confident that the New York Field Office would leak it and that it would come out regardless of whether he advised Congress or not.”

Yeah, so anyway!

Radicalized FBI Sleeper Cell Probably Led By Rudy Giuliani

James Comey Strikes Again (And Again And Again And Again)

Anthony Weiner’s Dick Explodes All Over Hillary Clinton’s Emails

Uh Oh, Did Adam Schiff Do TREASON COLLUSION With The Whistleblower’s Report? (No)

One more thing from Cox Richardson about what McGonigal did after his stint at the NY FBI office:

We also know that after McGonigal left the FBI, he went to work for Brookfield Properties, the multibillion-dollar real-estate company in New York that handled the bailout of Jared Kushner’s 666 Fifth Avenue by a $1.1 billion, 99-year lease—all paid up front—thanks to the Qatar Investment Authority.

And also went to work for Oleg Deripaska, which seems to tell us something about what kinda guy this dude is.

So yeah, huh! Weird stuff.

As she points out, these indictments aren’t about any of that stuff, but we kind of feel like — based on context clues — this guy might NOT end up being the guy who exposes the Deep State conspiracy where Hillary Clinton colluded with Russia and the FBI in order to steal the election from herself for the sole purpose of destroying the life and presidency of God-fearing patriot and humble servant Donald Trump.

We could be wrong.

Talking Points Memo has the indictments and much more on the charges related to the Albanian intelligence thingie, should you want to dive into the weeds.

Joe Manchin: ‘The Most Popular Republican In The Senate’

Fresh from his high five-ing trip with Sen. Kyrsten Sinema to meet with their real constituents in Davos, Sen. Joe Manchin returned to the Sunday shows to assure all of us that HE is the one who will ruin the Democratic Party’s attempts to make a better tomorrow. So let’s check out Joe Manchin and his amazing terrible friends.

Let’s Negotiate With Economic Terrorists

Appearing on CNN’s “State Of The Union,” Manchin is asked about the White House request for a clean debt ceiling bill. Manchin, ever the helpful stooge, took the “we won’t negotiate with Republicans on the debt ceiling” out of context to talk about a need to negotiate in governing. This accidental or willful misunderstanding did not go unnoticed by the side of the aisle all too willing to remove context so they can extort cuts to programs that help people.

But just in case we thought Manchin is only misguided and truly is a part of the solution, the senator from West Virginia quickly disabused us of that notion. When Dana Bash asked if he would support Democratic Rep. Ruben Gallego’s Senate run in Arizona, Manchin made it clear that he would instead support his Senate partner-in-obstruction.

MANCHIN: […] I have been voting for 40 years fairly conservative all the way through, and I think people know I’m in the middle and a centrist. […] I would think that she needs to be supported again, yes, because she brings that independent spirit. […]

Two things:

1) If you have been doing something for 40 years (or as a senator for 12 years) and nothing has drastically improved in your state, you have failed miserably.

2) Contrarianism, in and of itself, is not independence. It’s as dangerous a thing as mistaking speaking without thought, for speaking the truth. Don’t you think?

Speaking of…

Here Comes the “Both Sides” Express!!

Manchin then moved over to NBC’s “Meet The Press” where he proceeded to say stupid things with zero pushback from host Chuck Todd. When commenting on the investigation regarding how Joe Biden handled classifed documents, Manchin expressed what he presumably considered profound insight instead of a lazy false equivalence.

MANCHIN: It’s just hard to believe that in the United States of America we have a former president and current president basically in the same situation.

No, Manchin, they are not in the same situation as it’s been made clear numerous times already.

Manchin is in such a bubble, he made the following statement without seemingly realizing how deluded it is.

Hahahahahahaha! Jesus, Manchin would get crushed in a Democratic (or Republican) primary well before a general election.

Even Rep. Nancy Mace of South Carolina, in the effort to compliment Manchin, basically narrows down why he’s never gonna be President. (Roll Credits)

Mace, herself also tried to “both sides” the classified documents drama, but her effort was so asinine it momentarily woke up the journalist trapped in Chuck Todd’s sunken place.

MACE: Well, I think that’s because there’s no – there’s very little information about Biden. I mean, these documents were hidden for five years. We have very little information, whereas with the former president, everybody knows that those documents existed. They knew where they were. They knew where they were located. […] There was information that was presented to the public about —

TODD: Let me stop you there. We didn’t know where they were located.

MACE: – the number of documents, for example.

TODD: They defied a subpoena, it took a search warrant.

MACE: Well, the FBI and the DOJ —

TODD: In fairness, they didn’t know.

Mace also tried to downplay the possibility of a government shutdown and an economic default if the debt ceiling isn’t raised.

MACE: […] But, you know, this happened under the previous administration. The government was shut down for 35 days. There was a stalemate. But people still got paid. Accounts still got filled up. And the sky didn’t fall. […]

Nothing too bad happened except a threatened downgrade on our credit and an increase in the debt. Totally great, Mace.

On CBS’s “Face The Nation,” Republican Rep. Mike Turner from Ohio tried to “both sides” an insurrection when asked why Republicans seated 19 election deniers on the Oversight Committee.

Remind us again, when was the Democratic insurrection? We must have memory-holed and lost all the footage of liberals marching through the Capitol with coexist flags and screaming in the Senate chambers in Kitara Ravache garb to make John Kerry president.

On ABC’s “This Week,” Republican Rep. Michael McCaul from Texas also tried to assure us like a common Susan Collins that Rep. Marjorie Taylor Greene had learned her lesson and would grow into her office.

Who among us has not radically matured from a childlike 44-year-old to a fully grown 49-year-old adult?

But … But … Chicago!

Appearing on CNN’s “State Of The Union,” McCaul tried to downplay the need for gun reforms in the wake of another mass shooting by once again invoking Chicago gun violence. Thankfully, Bash pointed out the patchwork of gun laws in the US and that most of the guns in Chicago come from neighboring states with lax gun laws like Mike Pence’s Indiana.

Some dog whistles will never die.

Have a week.
